第一条 为保护社会主义的公共财产，维护财经法纪，发展社会主义经济，保障经济体制改革和社会主义现代化建设的顺利进行，根据《中华人民共和国宪法》和有关法律、法规的规定，结合本省实际情况，制定本条例。
第二条 企业单位必须加强成本管理。应该列入成本的支出，必须按制度规定列入成本。不准乱摊成本，挤占国家财政收入，不准弄虚作假截留税利，不准多报亏损骗取国家补贴。
第三条 企业单位必须正确计提和合理使用各项专用基金，保持企业的再生产能力。
折旧基金只能用于设备更新和技术改造，不准用于新建、扩建工程的开支。
税后留利必须按规定分配各项基金，不准把生产基金转为消费基金。
第四条 国家机关和企业事业单位的各项开支，必须执行国家和省的有关规定。不准任意扩大开支范围，提高开支标准。
严禁借参观、检查、评比、验收、经验交流会等活动之机，动用公款请客送礼。
第五条 国家机关和企业事业单位的工资支出，不准超过劳动人事部门或主管部门核定的工资总额。
国家机关和事业单位必须按国家和省的规定发放奖金、补贴，不得巧立名目提高标准，扩大范围。
国营企业应积极推行职工工资总额同本企业经济效益挂勾比例浮动的办法。执行其他工资制度的单位发放奖金超过限额的应依法缴纳奖金税。
不准挪用银行贷款、企业生产发展基金和其他专用基金发放奖金、补贴、实物。
国家机关和企业事业单位的工资基金，都应在银行开立专户，先存后用，由银行监督支付。
第六条 国家机关和事业单位不准用当年行政经费和事业经费搞基本建设。
使用自筹资金搞基本建设必须按规定严格履行审批手续。
第七条 各级政府都应如实编报财政预决算。编制预算坚持量入为出的原则，不准编赤字预算，编制决算不准虚列收入和支出，不准编报假决算。
第八条 凡有预算外资金的单位必须编造计划，一切收支都必须入帐，纳入综合财政计划，接受同级财政部门的管理和监督。所有收入都必须符合国家政策，应缴国家的收入要及时上缴同级财政。
不准将预算内资金转为预算外资金。预算外资金必须按规定的用途使用。
第九条 凡是实行企业管理的事业单位，收支相抵有盈余的，除按规定上缴财政和交纳能源交通重点建设基金以外，其余部分按规定的分配比例使用。
第十条 除有法律规定和国务院、省人民政府规定者外，任何单位和个人不得向企业事业单位强行摊派款物、随意罚款。否则，企业事业单位有权拒绝，有权向上级反映报告。
第十一条 任何部门、任何单位未经中国人民银行批准，不得开办金融业务及设置机构。经人民银行批准发给“经营金融业务许可证”的金融服务所（城市信用社），其存放款应纳入银行信贷计划，实行独立核算，自负盈亏，照章纳税。
人民银行和各专业银行应加强信贷管理和信贷监督。严格执行国家的信贷计划，做好信贷资金的平衡。申请贷款的单位，必须有一定比例的自有资金，并有适销适用的物资和财产作保证。不符合国家信贷政策规定的，不予贷款。
银行应核定国家机关和企业事业单位的现金库存限额，严格执行现金管理制度。
第十二条 国家机关、事业单位和工商企业所办的劳动服务公司、知青商店和家属厂店，在财务上必须与原单位分开，实行自主经营，独立核算，自负盈亏，照章纳税。
国家机关和企业事业单位及其工作人员，不准通过劳动服务公司、知青商店和家属厂店谋取私利。不准平调劳动服务公司、知青商店和家属厂店的资金和物资。
劳动服务公司、知青商店和家属厂店，借用的财产必须向出借单位缴纳占用费。
第十三条 国家机关和企业事业单位的负责人、财务机构的负责人和财务会计人员，都必须认真执行《会计法》。会计人员有权依法办理会计事务，进行会计核算，实行会计监督。单位负责人必须支持会计人员执行《会计法》，保障会计人员的职权不受侵犯。
严格执行财务交接制度。财务机构的负责人及会计人员离职时，必须清理帐目，办理财务交接手续。交接不清的，不得办理离职手续。
第十四条 国营企业的厂长（经理）在财务方面必须做到：
认真执行国家方针、政策和法律、法规；
全面完成国家下达给企业的指令性计划；
保证企业依法缴纳税金、利润，为国家积累资金；
保护由企业管理和使用的国家财产不受损害和侵犯；
按照国家规定提留和使用企业各项基金；
必须为企业的发展做出贡献。
第十五条 国营企业的财务实行民主管理，充分发挥职工代表大会的监督作用。职工代表大会听取和审议企业财务预决算报告，以及重大技术改造方案。工会和职工代表有权监督职工福利基金、奖励基金、劳动保护费的使用。
职工对于违反财务制度的行为和当事者，有权揭发和控告。
第十六条 各经济监督部门必须对国家机关和企业事业单位的财务进行严格监督。
审计机关依照法律规定，独立行使审计监督权，对财政经济活动实行审计监督，促进经营管理的改善，提高经济效益，维护财经法纪，保护国家财产。
财政部门必须加强对预算内、预算外资金的管理，监督检查财政法规、法令、政策、制度的执行，审查各级各单位的财政（财务）预决算的真实性，合法性。
税务机关必须监督纳税单位照章交纳税款，认真查处偷税漏税者。依照国家规定的权限严格控制减、免税收范围，不得随意减、免税收。
人民银行和各专业银行通过资金结算、发放贷款、现金管理等，对行政机关和企业事业单位的财务收支和经济活动进行监督，保证金融法规、法令、政策、制度的贯彻执行。
国家机关和企业事业单位，都应积极支持各监督部门的工作，对执行监督任务的工作人员要提供方便，不得设置障碍，进行刁难。
第十七条 凡执行本条例有下列事迹之一的单位或个人，分别给予荣誉奖励，或经同级人民政府批准给予物质奖励：
一、严格执行本条例，为发展经济、开辟财源作出显著贡献者；
二、严格执行本条例，坚持制度，坚守岗位，保护国家资财成绩显著者；
三、长期从事财务监督工作，在财务建设、维护国家资财中做出显著成绩者；
四、检举揭发违反财经法纪的行为和当事者。使国家资财减少或免遭损失者；
五、在财务监督检查工作中，认真负责，实事求是，办案有功者。
第十八条 凡违反本条例有下列情形之一的单位或个人给予惩罚：
一、对于违反财经纪律乱摊成本、乱列开支、截留利税、超越职权擅自减免税收的，应责令其纠正，情节严重的给予主要责任者行政处分或处以罚款；
二、偷税漏税的，根据情节轻重处以罚款、对主要责任者给予行政处分，直至追究刑事责任；
三、由于官僚主义和失职使国家资财受到较大损失的，给予行政处分。由于玩忽职守，使国家资财遭受重大损失触犯刑律的，由司法部门依法追究刑事责任；
四、明知故犯，弄虚作假，使国家资财受到损失的，除如数追回非法所得外，并对主要责任者处以罚款，或给予行政处分。数额巨大、情节严重的，由司法部门依法追究刑事责任；
五、参与违法活动或行贿受贿的，给予经济制裁，触犯刑律的，由司法部门依法追究刑事责任。
第十九条 对认真执行本条例的，要给予法律保护。对打击报复者从严惩处。
第二十条 各级人民政府应采取多种办法宣传贯彻本条例，领导和监督审计、财政、税务、银行等部门，依照法律行使财务监督权，查处违反本条例的案件，保障本条例的贯彻执行。
第二十一条 本条例适用于本省各级国家机关、事业、国营企业单位和县属（含市辖区）以上集体经济单位，也适用于委托地方进行财务监督的中央直属国营企业、事业单位、金融保险机构。
省有关部门可根据本条例和实际情况制定实施细则，报省人民政府批准后施行。
县（含市辖区）以下集体经济单位的财务监督，市、县人民政府可参照本条例制定监督管理办法。
第二十二条 本条例自1985年10月1日起施行。

为了加快实施沿海地区经济发展战略，促进我国沿海地区外向型经济的发展，国务院有关部门根据国务院关于清理涉外法规的部署和要求，对国务院发布或者批准发布的现行涉外方面的行政法规和法规性文件（以下简称法规）进行了清理。清理出来的第二批应予废止的法规12件，经
国务院清理涉外法规领导小组和国务院法制局逐件复查，国务院审议，决定予以废止（法规名称见附件一）。
同时清理出来的第二批自行失效的法规16件，也经国务院清理涉外法规领导小组和国务院法制局逐件复查，现一并附后（法规名称见附件二），以便各地区、各部门全面了解已失效的涉外法规的情况，利于工作。

CIRCULAR OF THE STATE COUNCIL CONCERNING THE ANNULMENT OF THESECOND BATCH OF REGULATIONS GOVERNING FOREIGN-RELATED MATTERS

CIRCULAR OF THE STATE COUNCIL CONCERNING THE ANNULMENT OF THE
SECOND BATCH OF REGULATIONS GOVERNING FOREIGN-RELATED MATTERS
(September 27, 1988)
In order to speed up the implementation of the strategy for economic
development in the coastal areas, and to promote the development of
export-oriented economy in the coastal areas of our country, the
departments concerned under the State Council, in accordance with the
planning and requirements of the State Council for the sorting out of
regulations governing foreign-related matters, have undertaken the sorting
out of the existing administrative regulations as well as other legal
documents (hereinafter referred to as "the regulations", for short),
promulgated by the State Council or promulgated with the approval of the
State Council. At present, the second batch of twelve regulations, which
have been sorted out and should be annulled, have been re-examined, piece
by piece, by the Leading Group under the State Council for the Sorting Out
of Regulations jointly with the Bureau of Legislative Affairs of the State
Council and by the State Council: and it is decided to announce the
annulment of the aforesaid regulations (See Annex I for the titles of the
aforesaid regulations). At the same time, the second batch of sixteen
regulations, which have become invalid automatically, have also been
sorted out and reexamined, piece by piece, by the Leading Group under the
State Council for the Sorting Out of Regulations jointly with the Bureau
of Legislative Affairs of the State Council: and now these sixteen invalid
regulations (See Annex II for their titles) are also included here as
Annex II in order to help various regions and departments concerned obtain
an overall understanding of the condition of those invalid regulations
Governing foreign-related matters, thereby facilitating their work.
